Archived Mod Idiocy

Fri Jul 27, 2007, 6:29 PM
  • Mood: Stumped
  • Drinking: Venom so I can spit more.
I love it when mods make up their own justification to remove images when they do not in fact violate the written rules.

Ferdy, :iconcallmepo: had his most recent fanarts of KimPossible removed. The age shown in the show and age to be legal does not show much in the way of change in real life people, so His style not only being a tad different, yet complimentary to the original style depicts her with more rounded features, which is an obvious means to age a character.

DeviantArt currently has no existing policy on Aging Characters for mature use. Unless they've completely hidden it, I'm right.

A reply in Ferdys journal links to a page by one I named as removing an image of mine that was clothed in the past, and he called it inappropriate nudity, which I actually blame for this stunt of art removal. Seems I was dead on by his post... [link]
Anyone who's dealt with his "MY DECISION IS FINAL" b.s. knows that that post is far from any amount of sarcasm, and instead is actually how he applies his rule enforcement.

Basically where he says you can't just age a character by doing what was done in this case, is not supported by the actual rules. ..at all. This is one persons insistence that cartoons always remain kid friendly no matter what, I would guess. His use of Naruto being a kid show is pretty inaccurate as well. Talk about not accounting for the actual CULTURE differences.. (and I'm not really a fan of the show)

So to the reply that supplied the link to that journal, I responded like so!
--------------------

It's funny how he's deluded himself to believe he's displaying links that prove he's right in doing what he's done.

Here I consult the Help and Faq area!
Faq#249 [link]
These rules apply equally to all forms of submissions and they apply equally to depictions of 'real life' persons as well as fictional characters
But does not say you cannot age the character.
(Edit! They changed it now! [link] and [link] . See new journal for current commentary-laughing.)

Faq#220 [link]
All deviations containing nudity, excessive violence, blood, gore, or other potentially upsetting or offensive material should be marked as Mature Content. Controversial pieces revolving around religion, political opinions and other similar sensitive subject matters should also be considered candidates to be tagged as Mature Content.
STILL does not say you cannot age characters.

Faq#465 [link] lists off what adult content is. Oh look! None of the images deleted off "callmepo"s pages fit the descriptions!
Also be aware that we prohibit providing an outside link to another website which provides access to the material described above. <- that..is actually why I believe Wagner deserved a ban for constantly supplying links he shouldnt have in his journal however. (I'm all about rules of the house, just not when people make things up to suit their needs!)

Faq#305 [link]
No attempt at self-censoring will allow an otherwise "Adult", obscene or pornographic work to remain in the deviantART galleries.
STILL nothing about aged characters..

Faq#60 [link]
We do not allow the submission of "Adult" or pornographic materials to deviantART under any circumstances.
stilllllll.... nothing about aged characters..

Then lets move to the Etiguette page! =D [link]
Certain content may be deemed obscene by the administration and as such the staff reserves the right to remove such content immediately upon discovery. The administration reserves the sole right to review and classify questionable material as obscene or not obscene
Oooo looky! A cover to hide behind! Now, We all know some dummies on the net will draw things expressly outlined in the pornographic clause and still try to combat this, but this is definately not the case here. Still this is one of those parts that work to the advantage of a mod looking to remove images that do not actually violate the rules.
Submissions of a non- photographic nature which clearly depict a minor, fictional character or otherwise, either nude or in a sexually driven manner will be removed and deleted without notice as they come to the attention of the staff.
And yet AGAIN nothing about matured characters who were aged for mature fanart exhibition.

Moving right along to Terms of Service! [link] =D =D
We reserve the right to amend these Terms from time to time in our sole discretion.
And none have been made to affect this particular situation.. and really if you read on, nothing else is actually relevant to this situation. Why he links to any of the places he does and feels he's perfectly in the right, is pure fantasy.

BUT~! Good old Faq#23 [link]
Deviations which are judged to lack a certain level of artistic quality can be removed without notice; typically this will occur to works which simply display a penis, testicle, vagina, breast, nipples, or buttocks.
Where basically the accusations HOLD TRUE against staff REMOVING artwork that is indeed following the rules, but they can HIDE behind the smokes screen of judging "artistic merit". As removals are subject to an individual mods notions of wrongdoing, so is their judgement of artistic merit. What is true for one, IS NOT TRUE FOR MOST, OR ALL.

So.. I laugh. I laugh good and hard. An indignant post by a smart-assed mod, hiding behind one line, in the faq, and nothing more to support his side.
DO PEOPLE HONESTLY THINK SOME OF US DO NOT READ THE RULES?? I'm on top of this crap every time there's a mentioned change!
--------------------

And I do read em. I spent a lot of time reading them in fact.. Just looking for things that supported what the guy said about how you can't age a character and post it in a mature way. They don't exist unless you count the faq#23 cop out.

The whole thing is absolutely stunning to me. STUNNING.

Also in regards to my own post.. BEHOLD Faq#303 [link]
Here at deviantART we enjoy providing a platform for our deviants to freely exchange ideas in a respectful atmosphere and we recognize that some individuals may hold viewpoints, political or otherwise, which are unpopular, scorned or outright hated.

While we absolutely prohibit the use of extremist beliefs as a means of harassment or abuse, we do not consider the mere association of such beliefs with an account or user to be an automatic violation of policy; we will remove an individual from our community based on the manner in which they interact and not by the simple basis of their beliefs, political, religious or otherwise.

As extreme as I am against that which I rail against, at least it's based upon facts and not done in the name of MEANNESS.

I think I am half-and-half on this Rule 34 material. I have seen works I felt tasteless and unnecessary, perverting characters and fiction I typically viewed as not being sexual or corruptable. However, there are artists I feel do it right, that do not cross that line that defines tasteful and tasteless sexualized fanart. Reiq comes to mind. Cyberunique's not too bad. In the case of FerdKat, I don't think there was an offense rendered or the line crossed.

Illustrators of your genre seem to make up the minority here. I felt that the size of this community should have permitted a reasonable accommodation for multiple genres. Like minds will group together, and users will find their niche and render themselves oblique to all other genres. To find works like what were deleted, a user would have had to shut of his mature filter and deliberately search users he knew to draw images of a suggestive nature.

There are works that I hate with a vengeance. Were I a moderator, would I go on a pyromaniacal blitzkreig against all the works that didn't appeal to me? I can complement this moderator for at least owning up to his behavior and rendering himself a lightning rod for this issue, but must lament him for being a castrated prude. This seems like vengeful activism, and I can't see the justification. I have seen some of the replies in the moderator's journal and wonder if this represents the consensus of the users of this site, or if he is generally attracting the positive feedback of an isolated populous featuring views polarized to his.

Is there room for everyone here? I discussed briefly with RandomReduX about his stance on the excessively-liberal guidelines of another website and had to agree with him that maybe the site amend its rules to ban lolicon. One can filter objectionable material from his or her search, but I would certainly not want to carry the stigma of other users whose activities I felt would reflect on us all. How much is a reasonable accomodation?

What was done right with FerdKat's illustration? He didn't draw sexual intercourse, which falls into the moderate policies of this site. He portrayed the character as an adult, which should be obvious. He didn't model the character in the Stephen Silver template, which helps tremendously. There were ways of doing this wrong, and I've seen them, and I think that his way was a way of doing it right.

Hanging the stigma of being a pedophile on a person for drawing works like that is more than libel ... dems fightin' words. People who don't like what FerdKat draws can just turn him off.

I can't help but wonder if this situation can possibly resolved in an acceptable manner for Ferdy or any of the other artists who do similar works. DeviantArt, at least in my experience, seems to give their mods a great deal of discretion in how to enforce the "rules." There is little hope in changing this particular mod's opinion (at least from what I've read of his posts), and I don't believe this is a situation where DeviantArt will be willing to back up the minority group of artists being trampled over. I could be wrong, obviously -- there very well may be someone on the staff that genuinely believes in the right to freedom of expression through art, even if they don't particularly agree with it. However, I wouldn't put too much hope in it. Honestly, it's DeviantArt's inability to accurately enforce its own policies or support its smaller user-bases that are the chief reasons I don't recommend anyone actually paying for a subscription at this website, although I guess I tend to subscribe to the method of using consumer buying power to influence the way a business runs.
